Gaia PDM: the plan in force in 2026, the revision and how to check your plot

Which PDM is in force in Vila Nova de Gaia, where the revision stands, what happens to urbanizable land, how to view the maps on Gaiurb, which rules apply to your plot, what maps and a PIP cost and when to request one.

The PDM in force in Gaia is the revision of the Plano Diretor Municipal (the municipal master plan) of Vila Nova de Gaia published in the Diário da República, Portugal's official gazette, as Aviso n.º 14327/2009 of August 12, 2009, and in force since August 13, 2009. Since then it has had one correction, four amendments and four amendments by adaptation, the latest in August 2024. The 2nd revision began in 2020 and, as of November 1, 2026, has not yet reached public consultation, so the 2009 plan, as amended, is what applies to every application. The consolidated regulations and the maps are on the website of Gaiurb, the municipal planning and housing company. This guide shows how to read the maps for your plot, sums up the regulations' figures, explains the risk around urbanizable land and covers when it is worth filing a pedido de informação prévia (PIP), the council's binding pre-application ruling.

01 Which PDM is in force in Gaia

The Plano Diretor Municipal (PDM) is the plan that zones all the land in a municipality; the general PDM guide explains how it works. In Vila Nova de Gaia, the plan in force comes from the revision approved by the Assembleia Municipal (the municipal assembly) on July 30, 2009, on a proposal from the Câmara Municipal (the city council). It was published as Aviso n.º 14327/2009 in Diário da República no. 155, 2nd series, on August 12, 2009, under the 1999 planning regime (Decree-Law 380/99), and has been in force since August 13, 2009.

The plan is made up of regulations with five annexes, a planta de ordenamento (land-use map) with maps for land qualification, mobility and transport, safeguards and plan implementation, and a planta de condicionantes (constraints map) with annexed noise and wildfire maps (article 3). The 2021 and 2024 adaptations added two safeguard maps, III-A and III-B. The table sums up the published acts.

02 The Gaia PDM revision: where it stands in November 2026

The council decided on February 17, 2020 to start the 2nd revision of the PDM, with a 24-month drafting period, environmental assessment and 45 days of preliminary public input (Aviso n.º 5075/2020 of March 25, 2020). The advisory committee that oversees the revision was set up by Aviso n.º 8814/2020 of June 8, and in early 2021 Gaiurb held participation sessions in every parish. According to Gaiurb, one aim of the revision is to bring the PDM into line with the new planning and land-use legislation.

The 24-month period set in 2020 has long passed. As of November 1, 2026, the Plataforma Colaborativa de Gestão Territorial (PCGT) of the Direção-Geral do Território, the national planning authority, lists the revision at the monitoring stage, with no public consultation or approval recorded, and Gaiurb's revision page gives no dates for the next stage. Until it is approved and published, the revision changes no rules.

When the draft goes out for public consultation, article 145 of the RJIGT (Regime Jurídico dos Instrumentos de Gestão Territorial, Portugal's planning instruments law) suspends PIPs, prior notifications and permit applications in the areas covered by new rules, from the start of consultation until the plan takes effect; if it has not taken effect within 180 days, the suspension ends. If you have a project in mind, it is worth getting the council's answer before then. Check Gaiurb's page and the Diário da República for whether consultation has opened before filing.

03 The 2009 PDM and urbanizable land

Gaia's plan predates the 2015 land classification rules and divides the territory into rural and urban land (article 8). Within urban land, it separates the urbanized zone from the zone of programmed urbanization, which includes urban expansion areas, planned industrial areas and tourism areas (article 137). In urban expansion areas, buildings and subdivisions are only allowed through a plano de pormenor (detailed plan) or an implementation unit, except for one-off projects on plots next to the urbanized zone that the council accepts (articles 70 and 139).

These areas are what the law calls urbanizable land or land for programmed urbanization. Article 199 of the RJIGT, as worded by Law 53-A/2025 of April 9, provides that in plans that had not adopted the new classification rules by December 31, 2024, the rules for those areas are suspended by decision of the CCDR (the regional coordination and development commission), after hearing the municipality; the suspension cannot be ordered if the municipality shows that the revision is close to completion. It does not cover, among others, areas that have already acquired urban characteristics or plots whose parameters were already set by a favorable PIP or an approved architectural design. The acts Gaiurb has published do not include an amendment adopting the new rules; if your plot is in an urban expansion area, ask Gaiurb or the CCDR Norte whether the suspension has been ordered. The guide on urbanizable land explains the rule.

04 How to check the Gaia PDM

The PDM is on the website of Gaiurb, Urbanismo e Habitação, EM, the municipal company that handles planning in Gaia. The Vila Nova de Gaia PDM page lists every published notice and declaration; the regulations page has the original text and a consolidated version updated to September 8, 2026; and the map pages have the land-use and constraints maps as PDFs, split into map tiles, at 1:10,000. The maps can also be viewed on the interactive map of Gaiurb's GeoPortal (sig.gaiurb.pt/geoportal).

In Gaiurb's own words, the consolidated version is a reference tool that does not replace the versions published in the Diário da República, which prevail. If you use the national SNIT geoportal run by the Direção-Geral do Território, check the date of the version you are viewing. The steps:

  • Find the property on the GeoPortal or identify which map tile it falls in on the PDF maps.
  • Read map I, Qualificação do Solo (land qualification), to see whether the property is rural or urban land and in which category and subcategory.
  • Open the safeguards maps, including III-A, for the incorporated special plans, and III-B, for flood risk, as well as the mobility and transport map.
  • Check the constraints map and its annexed noise and rural wildfire hazard maps.
  • Request a location map on the GeoPortal, under location maps and plans.
  • Read the consolidated regulations at the subcategory's article and the common provisions, and check the wording of any article you rely on in the Diário da República.

05 The Gaia PDM maps and what each says about your plot

Read every map, not just the land qualification map. The table shows what to look for in each, with the articles of the consolidated regulations.

Two rules deserve attention. In the Porto–Vila Nova de Gaia area at significant potential flood risk, outlined on map III-B, the rules in Title IX prevail over the land qualification (article 4(4)), and at high and very high hazard, construction and subdivisions are banned, with limited exceptions (articles 167 and 168). And in areas of the RAN (Reserva Agrícola Nacional, the national agricultural reserve) only farming and the uses allowed under the RAN regime are possible (article 21); see the guide on RAN and REN land.

06 How much you can build on urban land in Gaia

In urbanized areas, the surroundings set most of the rules. The building line is the prevailing one on the street (article 36), and in consolidated mixed areas the height is the prevailing height. Where no specific rule applies, the number of stories corresponds to a height of twice the distance between the building line and the center of the road, up to 6 stories (article 41). New main buildings must sit within a 35 m strip from the public space, with no second row of buildings, with exceptions such as detached four-sided houses and plots over 2,500 m² (article 42).

Some limits apply to all urban land. The building footprint cannot exceed 75% of the plot, including basements, except in justified cases (article 38). In buildings with two frontages, the maximum depth is 35 m on the ground floor and 17.5 m on upper floors (article 43). The table sums up the subcategories; the guide how much can I build on my land explains the concepts.

07 Rustic land in Gaia: what the 2009 PDM allows

The 2009 PDM calls rural land what current law calls rustic land, and divides it into agricultural areas, agroforestry areas, production and protection forest areas and rural estates (article 8). It allows a new single-family home in agricultural areas as a compatible use, with one dwelling, gross floor area up to 15% of the part of the plot in that category, 2 stories and impervious cover up to 20% (articles 23 and 24); agroforestry areas follow the same rules (articles 26 and 27). In forest areas, new housing is not among the compatible uses (articles 29 and 30). If the plot is in the RAN, the RAN regime prevails (article 21).

On rural estates, housing is allowed in mixed-use projects, with 2 stories and a floor area based on the estate's size: 0.10 of the area outside the RAN and the REN (Reserva Ecológica Nacional, the national ecological reserve) for estates under 5 hectares, 0.075 between 5 and 20 hectares and 0.05 above that, plus 0.01 of the remaining area (articles 33 and 34). An existing building on rural land can be converted to a single-family home if the land registry or tax records show it is lawful and predates the plan's public consultation, as long as the easements allow it (article 16(3)). In the flood-risk area, new buildings on rustic land are banned at high and very high hazard (article 167).

Getting land rezoned as urban is the most common wish: during the preliminary consultation for the revision that produced the 2009 PDM, about 81% of the requests asked for land to become urban. With the plan published, such a change can only come from a new planning procedure. See what is possible on rustic land and when rustic land can become urban.

08 Existing buildings, older PIPs and legalization

The regulations treat as pre-existing the buildings and activities that needed no permit, those with a valid and effective permit or authorization, and rights protected while they remain valid, such as favorable PIPs and approved architectural designs (article 16). If they do not comply with the plan, changes are allowed that do not worsen or that reduce the non-compliance, as well as new uses that comply with the plan. A favorable PIP that is still valid therefore counts as pre-existing; check the validity of the PIP.

For buildings without a permit, article 18-B lets the council license existing residential, facility, retail or office buildings that do not fit their land-use category, provided they meet the easements, appear on the mapping used as the basis for the plan, have their structural stability vouched for by a responsible engineer and meet the minimum legal requirements. The council can attach improvement conditions. The process is explained in the guide on how building legalization works.

09 Maps, certificates and fees in Gaia in 2026

Fees are set in the Regulamento de Taxas e Outras Receitas do Município de Vila Nova de Gaia, whose 2026 update has been in force since April 1, 2026 and is published by Gaiurb. The table still refers to PIPs by paragraphs 1 and 2 of article 14 of the RJUE, which correspond to the simple and the extended PIP. Check the amount before paying.

10 When to request a PIP in Gaia

Reading the PDM gives you an interpretation; a decision on a pedido de informação prévia (PIP) gives you an answer that binds the council. Under the RJUE (Regime Jurídico da Urbanização e Edificação, Portugal's planning and building code) as revised by Decree-Law 108/2026, in force since October 1, 2026, a simple PIP confirms feasibility and constraints, and an extended PIP assesses the project in more detail. The council has up to 20 days for its initial check and then decides within 15 days (simple) or 30 days (extended; 45 for subdivisions); without a decision in time, the PIP is tacitly approved, and a favorable answer is valid for 2 years. In Gaia, applications are filed through Gaiurb's Balcão Virtual (online counter), which has the forms, filing rules and manuals, and filing and case tracking. The PIP guide explains the rules.

In Gaia, a PIP is worth it when:

  • The plot is in an urban expansion area or another zone of programmed urbanization and you need to know whether the council will accept a one-off project and whether the rules have been suspended.
  • What you can build depends on the prevailing height or building line, the 35 m strip or the maximum building depth.
  • You want to build a house in an agricultural or agroforestry area or on a rural estate, or convert an existing rural building into a home.
  • The property is in the flood-risk area on map III-B, on the coast or next to listed heritage.
  • There is a building without a permit and you want to know whether it fits article 18-B.
  • You are buying and want the promissory contract to depend on the answer: see PIP before buying land. Apto Group prepares and follows up your PIP in Gaia.

11 Frequently asked questions

Which PDM is in force in Vila Nova de Gaia?

The PDM revision published as Aviso n.º 14327/2009 in the Diário da República on August 12, 2009, in force since August 13, 2009. It has had one correction, four amendments and four amendments by adaptation, the latest through Declaração n.º 60/2024/2 of August 21, 2024.

When will Gaia's new PDM take effect?

There is no date. The 2nd revision began in 2020 and, as of November 1, 2026, is at the monitoring stage, with no public consultation open. Once consultation starts, applications in areas with new rules will be suspended until the new plan takes effect, for up to 180 days.

Where can I check the Gaia PDM online?

On Gaiurb's website: the PDM page lists every notice, the regulations page has the consolidated version updated to September 8, 2026, and the maps are available as PDFs and on the GeoPortal interactive map. If they differ, what was published in the Diário da República prevails.

Can I build a house on agricultural land in Gaia?

The PDM allows a single-family home in agricultural and agroforestry areas, with one dwelling, floor area up to 15% of the plot in that category, 2 stories and impervious cover up to 20%. If the land is in the RAN or a flood-risk area, those rules prevail, and new housing is not provided for in forest areas.

My plot is in an urban expansion area. Can I build?

As a rule, only through a detailed plan or an implementation unit, except for one-off projects next to the urbanized zone that the council accepts. On top of that, the rules for these areas can be suspended by the CCDR Norte under article 199 of the RJIGT. A favorable PIP that sets the parameters is outside that suspension.

How much does a PIP cost in Gaia?

In the 2026 fee table, a simple PIP costs €53.35, and an extended PIP for building work costs €204.65 up to 2,500 m² of floor area or €312.35 above that. Technical preparation and any topographic survey are extra.
